General Terms and Conditions of the Online Shop

Scope of Contract

For all deliveries from Eight Bit UG (haftungsbeschränkt) (hereinafter referred to as “Provider") to consumers these General Terms and Conditions (GTC) apply. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed primarily to their commercial or independent professional activity.

The provider may offer other products and services on different terms. These conditions only apply to the delivery of products to consumers.

Conclusion of Contract

The presentation of products in the online store does not constitute a legally binding offer, but only an invitation to order.

By clicking on the button [Buy/Order with costs] you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending you an order confirmation by e-mail immediately after receiving your order.

Right of Withdrawal

If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.

If you make use of your right of withdrawal as a consumer, you must bear the regular costs of the return shipment.

In all other respects, the provisions set out in detail in the following apply to the right of withdrawal.

Withdrawal Policy

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. An exception to this applies in accordance with § 312g Sec. 2(1) German Civil Code (BGB) for custom build products. In the case of such custom build products, the right of withdrawal is only valid until the start of production of the respective product.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You can also fill in and send a clear declaration electronically on our website. If you make use of this option, we will immediately send you a confirmation of receipt of such a revocation (e.g. by e-mail).

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.

You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

Prices and Delivery Costs

The prices stated on the product pages include VAT and other price components.

In addition to the prices quoted, we charge shipping costs for delivery. The shipping costs are clearly indicated on the product pages, in the shopping cart system and on the order page.

Delivery

Delivery is only possible within the EU with DHL, DHL Express, Hermes, DPD or UPS.

Delivery time within Germany is up to 5 business days. We will indicate any differing delivery times on the respective product page.

Delivery time within the EU is up to 10 business days. We will indicate any differing delivery times on the respective product page.

Undeliverability

If an order cannot be delivered, for example due to incorrect address details or absence during delivery, the customer shall bear all costs incurred as a result in accordance with § 280 Sec. 1 and § 241 Sec. 2 BGB. This includes in particular the return costs and the shipping costs for a new delivery attempt. According to § 273 BGB, a new delivery will only be made once the customer has paid these costs in full. A failed delivery does not lead to a withdrawal from the purchase contract for the buyer according to § 433 Sec. 2 BGB.

Reservation of Title

The goods remain our property until full payment has been made.

Warranty against Material Defects

The provider is liable for material defects in accordance with the applicable statutory provisions, in particular §§ 434 et seq. BGB
